Argentine Court Says Captive Ape Has Human Right To Freedom

An orangutan held in an Argentine zoo can be freed and transferred to a sanctuary after a court recognized it has a “non-human person” unlawfully deprived of its freedom, local media reported on Sunday. Yahoo! News has more:

Animal rights campaigners filed a habeas corpus petition – a document more typically used to challenge the legality of a person’s detention or imprisonment – in November on behalf of Sandra, a 29-year-old Sumatran orangutan at the Buenos Aires zoo.

In a landmark ruling that could pave the way for more lawsuits, the Association of Officials and Lawyers for Animal Rights (AFADA) argued the ape had sufficient cognitive functions and should not be treated as an object.

The court agreed Sandra, born into captivity in Germany before being transferred to Argentina two decades ago, deserved the basic rights of a “non-human person.”

“This opens the way not only for other Great Apes, but also for other sentient beings which are unfairly and arbitrarily deprived of their liberty in zoos, circuses, water parks and scientific laboratories,” the daily La Nacion newspaper quoted AFADA lawyer Paul Buompadre as saying.

Fulani Herdsmen Threaten To Attack Abia Village Over Missing Cows, Little Boy

Residents of Okporenyi village in Bende Local Government Area of Abia State have been sleeping with one eye closed over fears of possible attack by Fulani herdsmen following a face-off between the community and the nomads.

The Fulani herdsmen were said to have threatened to attack the community if the people failed to produce the cows allegedly stolen by the villagers.

Tracing the genesis of the problem, a member of the village said that on Christmas Eve, a group of herdsmen suddenly showed up in the village, threatening to attack the villagers if they did not produce their missing cows.

According to the source, farmlands and valuable crops in the village have been destroyed by cows belonging to the Fulani herdsmen and despite complaints by the villagers, the cattle rearers refused to find an alternative means of feeding their cattle.

The source further said that the herdsmen later came to the village accompanied by some policemen, alleging that they were searching for one of their cattle rearers, said to be a little boy.

Speaking further, the source claimed that an attempt by one of the villagers, simply identified as Onyi, to exonerate the village from any involvement in the whereabouts of the allegedly missing boy, led to a face-off with one of the herdsmen, who inflicted a machete cut on his upper arm.

He said the villagers had been living in a state of fear of imminent raid by the herdsmen, who had been fingered in some attacks on communities in the Middle Belt as well as part of Enugu State in recent times over grazing land.

When contacted, the Abia Police Public Relations Officer, Mr. Geoffrey Ogbonna, confirmed the incident but said, “Police are on top of the situation”.

Ogbonna, a DSP, said talks had been initiated with both parties with a view to resolving the face- off. He also assured the villagers of full protection of their lives and property but advised them against taking laws into their hands.

Former Head of State and Presidential candidate of the All Progressives Congress in the 2015 general elections, Maj.-Gen. Muhammadu Buhari (retd.), has told the Independent National Electoral Commission that his academic qualifications and credentials are with the military.

This came to light on Monday when journalists visited the headquarters of INEC in Abuja.

Unlike those of other presidential candidates, whose academic qualifications were on display including President Goodluck Jonathan of the Peoples Democratic Party (PDP), Buhari’s own were conspicuously missing.

However, the development was better explained in an affidavit the APC presidential candidate deposed to before an Abuja High Court.

According to him, all his certificates were with the Secretary, Military Board. The affidavit was dated November 24, 2014 and was stamped and received by INEC on December 18, 2014.

“I am the above-named person and deponent to this affidavit therein. All my academic qualifications documents as filled in my presidential form, President APC/001/2015, are currently with the Secretary, Military Board as of the time of presenting this affidavit. The affidavit is made in good faith and for record purpose”, Buhari stated.

What a waste and sheer negligence on the part of our health system in our dear Country over a mere post-ectopic pregnancy surgery complications that led to Septic Shock which ultimately aggravated to septic shock. Within 3 days, in 3 different health Institutions presumed to be good if not first class in Lagos State. It is saddening and harrowing for my friend Adebomi Taiwo to lose his best friend, partner, heartthrob, confidant, wife and mother of their wonderful son in such a pitiable circumstances especially when he was willing to do everything humanly possible to save the adorable wife.


For me, it was painful to lose someone i had reasons to learn one or two in-tricks about Digital Marketing professionalism from during the process of sealing a lucrative contract. I have had 2 weeks of eventful reasons to have observed her from close quarters in company of the Husband and we all appreciated her impeccable touch of excellence in her field of endeavor coupled with her humble and easy going mien at home and at work. I pray that God will give my friend, her darling immediate sister, mother-in-law and her own mum who shared the 3 days of hellish throes at the Hospitals with us. My friend paid so heavily to the hospitals yet he never got the premium service delivery that he wanted and became delusional.

My only source of joy was that she was a true believer, compassionate and a loving,submissive wife to the Husband. ECTOPIC PREGNANCY, SEPSIS or SEPTIC SHOCK or whatever did not win because she is actually resting in the bosom of our dear lord. It was a glorious exit, an impact-ful life devoid of any skirmishes. She was a great personality, adorable even at her workplace-First Bank PLC where her fellow staffs are still in a shock. DEATH WHY! DEATH WHY MUST IT BE Bose Oyawale Adebomi at all. I PRAY THAT MY FRIEND WILL HAVE THE FORTITUDE TO BEAR THE LOSS.

The news is that Lagos State Waste Management Authority (LAWMA) said yesterday that it would soon turn the Olusosun dumpsite in Ojota into a golf course. Tagged as Nigeria's most popular refuse dump, Olusosun has been a subject of foreign documentaries in the past because of the many activities of scavengers at the site.

The managing director of LAWMA, Mr Ola Oresanya, said the golf course project would come under the agency's second 10-year-rolling plan.

"In the rolling plan, we are focusing downstream and our downstream is at the disposal sites. Our landfills development is a real focus, we already sign contract for development of our state of the heart landfills sites at Epe and Badagry. And those landfill sites are the real focus for the next rolling plan and a site also will be located in Ogun state. That is around Mowe/Ibafo area that we took over. Then we will close down the Olusosun dumpsite completely and turn it into golf course. We will continue to build transfer stations and material recovery plants in Lagos".


"Those are parts of the ten year rolling plan and we will increase our waste conversion to almost 70 per cent to 80 per cent of the wastes we generate in Lagos. The wastes will now be converted to something very useful within that ten years rolling plan. Then, we want to make sure that we get the economics of waste management very well and the economics must be perfect within the next ten year. So those are the key ingredients of those plans.''

Four armed robbery suspects identified as Onyenge Osanie, Azuka Eboh, Ezelonwu Michael and Afolabi Shakiru, all  pictured above who were arrested by officers of the Lagos state Police state command for looting shops and stealing from some phone dealers at the Alaba International Market in Lagos on December 20th, told the police that they did not steal from the traders but only collected their dues as the phone dealers failed to settle them after they supplied them with stolen phones. 

According to Punch, the ten-man gang, with other members still at large,  raided mostly shops of phone dealers, stealing 70 smartphones and Ipads which were worth about N1.5m.

When interrogated, one of the suspects, 35 year old father of three, Onyenge Osanie said 

"We usually work with phone dealers in the market who specialise in selling stolen phones. When we steal, they sell, and they then settle us. But later on, some of them defaulted, and we attacked their shops. It was not as if we robbed them, we only came to ask for our money. On that day, we had taken only 10 phones before the police apprehended us. I had initially escaped, but two gang members who were caught at the scene later brought the police to arrest me." he said


Another gang member, 27-year-old Eboh said he joined the gang because of his unemployment status "What we learnt initially was that a market chairman was coming to give out money but he later failed to show up. That was when we decided to deal with the traders. When we got to the shops, we broke their glasses and carted away expensive phones. I joined the gang because I did not have a job. I have been living in hardship with my family."he said


Another gang members, 22 year old Michael who claims to be an ex truck driver said their robbery act wasn't deliberate

"I was working as a truck driver before I met them. I had gone out with the gang on three occasions to rob in the market. We only took advantage of the commotion of the market to rob them. It was not deliberate," he said.


Police Public Relations officer, DSP Kenneth Nwosu while confirming their arrest, said investigation is going on the matter.

Barely one year after Nigerians stopped him from turning the National Theatre into a hotel, the Minister of Culture and Tourism, Edem Duke, secretly jetted off the country to the United Arab Emirates, UAE, where he traded off the nation's cultural pride to Mulk Holding, a diversified UAE-based conglomerate with interests in retail sector and other businesses. The secret deal which was successfully shielded from the Nigerian media, in spite of a subsisting concessioning arrangement with the Bureau of Public Enterprises, BPE, was signed and sealed in December , 2014 between a delegation led by Duke, the General Manager of the National Theatre, Kabiru Yar'Adua and representatives of Mulk Holding, said to be ploughing the sum of $40 million (about N7.5 billion) counterpart fund into the project.

According to GulfAfrica Review, in its December 10, 2014 edition, Sharjah's Mulk Holdings, a diversified UAE-based business conglomerate, "has announced its entry into the retail sector in West Africa through a $40m joint venture to develop Nigeria's National Arts Theatre in Lagos into a duty-free shopping centre in partnership with the Suzanne Group.

"The interior of the National Theatre will be redesigned and renovated into a modern duty-free and retail shopping mall. The project will convert approximately 30,000m2 of the existing space in two 15,000m2 phases," said Kabir Yaradua, CEO of the National theatre.

The report continues: "The National Theatre has been the hub of cultural activities in Nigeria since 1976, and this will kick-start a master re-development programme for this area."
The report quoted Ambassador of Nigeria to the UAE, His Excellency Bashir Yuguda, as saying: "The National Theatre has been the hub of cultural activities in Nigeria since its establishment in 1976, and this development will compliment and kick-start a master re-development programme designed for this area."

The National Arts Theatre was originally built for the Festival of Arts and Culture in 1977, and later underwent a controversial privatisation after 2001 under President Olusegun Obasanjo.
Fresh plans further anticipate leasing the land around the theatre in a 30-year concession.
Minister of Tourism, HE Edem Duke, noted: "As part of the continuous drive to promote culture and tourism, the federal government is making necessary arrangements to transform the land into a modern mixed-use commercial and business hub of global standards."

Arif Hafiz, Managing Director of Suzanne Group, praised the "milestone contract" Mulk Holdings as "one of the major global business groups in the UAE", while Shaji Ul Mulk, chairman, Mulk Holdings, elaborating on the details of the project, noted that is expected to be completed in 2016.
"Mulk Holdings is adopting aggressive strategies to expand its core business, involving serious investment into existing businesses and diversification into sustainable industries," Ul Mulk added.
According to a report by audit firm Ernst&Young, Africa's retail and consumer sector received about 17% of all foreign direct investment that came into the continent in 2013.

Mulk Holdings and its joint venture partners own and manage a group of 20 companies with a sector focus on construction and fit-out manufacturing, as well as diversified business interests in trading, commodities, real estate and energy, spread across 48 countries.

Based in Dubai, the Suzanne Group caters to duty free shopping outlets in international airports and seaports, and is a registered supplier of services to the offices of the United Nations.
Though the theatre had been a victim of public sector incompetence, its final descent into the ignoble hall of shame of failed public institutions started in 2001 when the Obasanjo civilian government served notice of its intent to privatize the monument. Converting a public institution into a successful private enterprise has never captured the fancy of Nigerians. Many of such previous attempts at privatization of public institutions have failed and the case of the National Theatre was not different. Between 2001 and now, the theatre has remained a mere ball for government ping-ponging. It is yet to be sold or concessioned, worst still the federal government which is the original owner of the facility is behaving as though it is the least of its worries: unserious.

A staff of the theatre told our correspondent that the employees are more confused than anybody. "We don't know our fate. Today we hear they want to privatize it and build a 5-star hotel here, tomorrow we hear a different story. This is confusing and it is affecting our morale and commitment because nobody, not even our senior staff can say categorically that this is the true situation of things.
"We believe the management of the theatre is doing this deliberately to give the impression that the theatre cannot function effectively if left in the hand of government. We believe it is a cheap way to arm-twist government to sell the national pride. But some of us have travelled far and wide and we have seen equivalent institutions in other countries being managed by the public sector and they are efficient".
Political Economist investigation showed that the theatre has become a victim of power play orchestrated by the Tourism Minister, Edem Duke, in concert with the General Manager of the Theatre, Mallam Kabiru Yar'Adua both of whom, stakeholders allege, are intent on disposing of the national monument for peanuts. The Theatre, they argue, was set up by a decree just like the National Troupe and other parastatals of the Ministry of Tourism and they see no reason why it should be sold off on the whims of a minister and a manager. They cited the case of the United States where certain monuments are still held in custody of government.
For instance, the United States government enacted a law in 1846 to support and preserve the Smithsonian Institution and its 19 museums across the country. In UK, the Royal National Theatre and Royal Shakespeare Company are publicly funded theatre outlets and they are still relevant till this day. The case of the National Theatre cannot be an exception, they warned.
The National Theatre has been a victim of government policy flip-flop. The BPE commenced the concession transaction of the National Theatre in 2001 following the conclusion of World Bank-financed diagnostic study and Transaction Advisory service in line with international best practices. The first concession transaction in 2001 led to the pre-qualification of the following prospective concessionaires:
Jadeas Trust Consortium, andLloyd Anderson Investment Limited.In January 2003, the pre-qualified concessionaires conducted data room and physical due diligence. The transaction was stalled, however, owing to the inability of the Ministry of Culture and Tourism to provide relevant documents such as Power of Attorney as well as building and floor plans of the National Theatre.
The BPE did another concession transaction of National Theatre in 2006. Eight Consortia responded when the Bureau advertised for Expressions of Interest. This led to the financial bid opening on May 17, 2007 where Infrastructica Consortium emerged as the Preferred Bidder with a bid price of ?35, 560, 000,000 and Jadeas Trust Limited as the Reserved Bidder with an offer of ?28, 902,948,593.23.
Following the approval of the results of the financial bid by the NCP, an offer letter was sent to the Preferred Bidder on May 18, 2007 and a timetable to complete the concession agreement by May 28, 2007 was drawn. Unfortunately, the Preferred Bidder, Infrastructica Consortium, failed to meet the terms of the offer, leading to the termination of the offer. The Reserved Bidder, Jadeas Trust, was thereafter invited for negotiation to pay for the enterprise.

However, the process to conclude the transaction with Jadeas Trust was stalled.
The NCP at its first meeting on January 22, 2013 approved the resumption of the concession transaction by the BPE with a view to bringing it to conclusion. The BPE has consequently invited the reserve bidder, Jadeas Trust Consortium with the offer of N28,902,948,593.23 to present a revised technical and financial proposal. The N28.9 billion bid offer, which is not yet concluded as it will form part of the renegotiation with Jedeas Trust, comprises both Entry fee and yearly lease fees to be paid over a 35-year period. This is different from the investment capital to be based on approved Post Concession Business Development Plan from which the Concessionaire is to recoup its investment and return the enterprise to the Government after 35 years in the event that the concession is not renewed.

The NCP, in line with its practice to carry along ministries whose enterprises are being privatized/concession, also approved that the BPE should invite the Honourable Minister of Tourism & Culture to participate in the NCP's technical sub-committee that will evaluate the proposal of Jadeas Trust.

Jadeas Trust Consortium has submitted a revised Technical and Financial proposal to BPE. In accordance with NCP's decision, the BPE has written the Ministry and the Management of National Theatre to send two nominees each to join the evaluation committee that will assess Jadeas Trust Consortium's Technical and Financial proposal.

The BPE is awaiting the response of both the Ministry and Management of National Theatre for the evaluation of the Technical and Financial proposal to begin in earnest. The result of the evaluation team will be presented to, first the Technical Committee of NCP for consideration before the Technical Committee presents its recommendations to the NCP for approval or further directive.

At the Federal Executive Council's meeting (FEC) held on Wednesday June 26, 2013 an Inter-ministerial Cabinet Committee was set up to consider the parallel concession transactions being carried out by the BPE and the Ministry of Tourism, Culture and National Orientation.
With the new development being spearheaded secretly by the minister, it is not clear what has become of the earlier concessioning arrangement and the status of Jadeas Trust.

If I needed money, I wouldn't sell $5 T-shirts. I'd sell a Grammy or an MTV award. So that is insulting to think we need to sell $5 T-shirts. No, I don't think so."
